Acceptance of terms
By creating an account or running a search on facesearching (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms, in which case "you" refers to both you and that organization.
Permitted use
You may use the Service only to search for images that you own or have explicit permission to search — for example, your own face, or a photo you control. You are solely responsible for ensuring your use complies with all applicable laws.
You agree to provide affirmative consent before each search, and to use the results responsibly. Results are provided as leads for your review and do not constitute definitive identification.
Prohibited use
You may not use the Service to: (a) stalk, harass, intimidate, or harm any person; (b) search for the face of a minor; (c) search for an image you do not own or lack permission to use; (d) impersonate another person or entity; (e) reverse engineer, scrape, or otherwise disrupt the Service; or (f) use the Service for any illegal purpose.
We may suspend or terminate your account immediately, without notice, if we believe you have violated these Terms. Search credits are non-refundable in cases of termination for cause.
Accounts and credentials
To use paid features you must create an account. You are responsible for keeping your password secure and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.
You must be at least 18 years old to create an account. We do not knowingly allow minors to use the Service.
Credits and payments
Paid searches are deducted from a credit balance. You can purchase credit packs as listed on our pricing page. Payments are processed by a third-party payment provider; we never store your full card details.
Unused credits do not expire as long as your account is in good standing. Credits are non-transferable and, except where required by law, non-refundable. If a search fails due to an error on our side, we will restore the credit to your account.
Results and accuracy
The Service returns results sourced from publicly available web pages. Each result includes a confidence score to help you judge the likelihood of a match. Results are estimates and should not be treated as definitive.
We do not guarantee that any search will return results, nor that returned results are accurate. You are responsible for verifying any result before taking action based on it.
Privacy
Our handling of your data, including uploaded photos, is described in our Privacy Policy. By using the Service you consent to that data handling as described there. Your photo is deleted after each search.
Intellectual property
The Service, including its design, software, and branding, is owned by facesearching and protected by intellectual property laws. Results returned by the Service point to third-party content that we do not own; rights in that content remain with their respective owners.
You retain ownership of the photos you upload. By uploading, you grant us a limited, non-exclusive license to process the photo solely to perform the search you requested.
Disclaimer
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or complete.
Limitation of liability
To the maximum extent permitted by law, facesearching shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of your use of the Service.
Our total aggregate liability for any claim arising from the Service shall not exceed the amount you paid us in the three months preceding the claim.
Termination
You may delete your account at any time by contacting support. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including intellectual property, disclaimer, and limitation of liability) will remain in effect.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top of this page. For material changes, we will provide notice by email or an in-product notice. Continued use after changes take effect constitutes acceptance of the new Terms.
